Introduction
- The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL No. 241 411 (operating under the brand ‘Budget Direct’) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066, contact number 1300 858 747 (‘we’, ‘us’, ‘our’ or ‘Promoter’) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).
How to Enter
- These Terms and Conditions apply to the promotion “Dwayne Bennett’s Ultimate Dolphins NRL & Budget Direct VIP Package” where entrants must, during the Promotion Period:
- follow Dwayne Bennett’s Facebook page at https://www.facebook.com/imdwaynebennett/;
- Tell us in 25 words or less why you would like to experience the Dolphins take on the Sea Eagles live at Lang Park? and
- complete all required steps and fields on the entry form, including by providing their first and last names and a valid email address, and submit the form via https://bdins.co/DwaynesDolphinsPackage
for the chance to win one (1) of five (5) Dolphins NRL VIP packages (see the Eligibility and Participation section below) (Promotion).
- The Promotion commences at 11:00am Wednesday 17th April 2024 and ends at 11:00am on Tuesday 30th April 2024 (Promotion Period). All times are in Australian Eastern Standard Time.
- The Promotion is a game of skill and chance plays no part in the determination of the winners.
- Entry into the Promotion and any offer of Budget Direct insurance is subject to the Insurer deeming that the risk is acceptable in accordance with its underwriting criteria.
- Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
Eligibility and Participation
- Entrants must meet all of the following criteria during the Promotion Period and at the Draw Date to participate in the Promotion (Eligible Entrant):
- be aged 18 years or over;
- be an Australian resident. Australian resident means a person who resides in Australia and either:
- holds Australian or New Zealand citizenship; or holds an Australian permanent residency visa; or
- has resided in Australia continuously for six (6) months or more on a temporary work visa at the time of participating in the Promotion;
- not be a director, officer or employee of the Promoter, its related entities or agents and service providers, or any other person directly associated with the conduct of the Promotion or their immediate families;
- be a current and eligible ‘Phinlander’ who has previously signed up via https://www.phinland.com.au/ by inputting the requested details and submitting the fully completed membership form;
- provide a valid email address;
- agree to accept the Promotion’s Terms and Conditions; and
- agree to receive marketing from the Promoter.
- Each Eligible Entrant will be awarded a maximum of one (1) entry into the Promotion. Additional entries will not be awarded for additional entry form submissions.
- Entries will be deemed accepted at the time of receipt by the Promoter, or as determined by the Promoter. Entries received will be considered final by the Promoter.
- The Promoter reserves the right to disqualify or delete any entry which contains (in the reasonable opinion of the Promoter) any content which is incomplete or indecipherable or contains profanity, potentially insulting, scandalous, racist, unlawful, abusive objectionable, inflammatory, or defamatory language.
- The Promoter may request the Entrant produce appropriate photo identification and other documentation to confirm, to the Promoter’s satisfaction, the Entrant’s eligibility to enter the Promotion and the validity of their entry, failing which any/all entries of that Entrant will be deemed invalid.
- If there is a dispute regarding the conduct of the Promotion, Entrants agree that the decision of the Promoter will be final and no further correspondence will be entered into.
Draw and Prizes
- The Judging will take place at Level 7, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066 at 01.00pm (AEST) (Judging Time) on Tuesday 30th April 2024 (Judging Date).
- All entries will be judged by a panel of judges individually on their merits based on creativity. The five (5) best entries, as determined by the judges in their absolute discretion, will each win one Prize set out below (Eligible Winners). The judges’ decision is final and binding and no correspondence will be entered into.
- The prizes are five (5) x Dolphins NRL & Budget Direct VIP Packages (each, a Prize) valued at AU$3,317.40 each. Each Prize comprises of the following items:
- 2 x Budget Direct Corporate Box tickets including a Grazing Platter to the Dolphins vs Sea Eagles NRL game at Lang Park Stadium, Brisbane (Game) at 7:50pm on Thursday 9th May valued at $667.40
- 1 nights’ accommodation for 2 people on 9th May 2024 in Brisbane City valued at up to $400;
- Transport to the Game within Australia as follows (capped at $2,000 in value):
- If you live under 200kms from Brisbane, we will arrange for transport from your place of residence to Brisbane; or
- If you live in Australia but 200kms or more from Brisbane - 2 x return economy flights from the Eligible Winners nearest capital city to Brisbane;
- $250 Mobile Pay eGift card
All expenses other than those expressly referred to in this clause 15 will be at the winner’s and their companion’s cost. The Promoter will not be liable for the failure of the winner to meet travel schedules or cancellations and no cash or other prize will be awarded if the winner or the companion cancels for any reason. The Prize is not transferable and is not redeemable for cash.
- The total value of the prize pool is AU$16,587.00 (excl. GST).
- Each Eligible Winner will be notified via their nominated email address provided on the entry form with particulars of how the Prize is to be delivered within five (5) hours of the Judging Time, or by no later than 6:00pm (AEST) on Tuesday 30th April 2024, and their name will be published on the Terms and Conditions page via https://www.phinland.com.au/terms-conditions/dolphinsvseaeagles within twenty-eight (28) days of the Judging Date, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to identify and notify the winners.
Unclaimed Prizes
- A Prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner by 10:00am (AEST) Friday 3rd May 2024 (Unclaimed Prize Date) in accordance with clause 17.
- If a Prize remains unclaimed at the Unclaimed Prize Date, the next best entry/entries as selected by the panel of judges will be awarded the Prize/Prizes. If for whatever reason a prize winner does not redeem the Prize or an element of the prize by the time stipulated by the Promoter, then the Prize will be forfeited by the prize winner.
- The Eligible Winner of the Unclaimed Prize will be notified via their nominated email address provided on the entry form with particulars of how the Prize is to be delivered by no later than 4:00pm (AEST) Friday 3rd May 2024, and their name will be published on the Terms and Conditions page via https://www.phinland.com.au/terms-conditions/dolphinsvseaeagles within twenty-eight (28) days of the Unclaimed Draw Time and Date, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to identify and notify the winners.

- The Promoter is committed to protecting your Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website at the following link: www.budgetdirect.com.au. It contains information about how entrants can complain about a breach of the Australian Privacy Principles and further details of how the Promoter will collect, store, use and disclose Personal Information can also be found there. Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at [email protected].
- Entrants acknowledge that a further purpose for collection of their Personal Information is to contact the Entrant in the future with information about the Promoter or Insurer, including special offers, market research or to provide marketing materials via any medium including mail, and any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
- The Promoter will never sell an Entrant’s Personal Information to other companies, however, the Promoter may share an Entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties, who may contact the Entrant for their legitimate commercial purposes. Some of these parties may be located outside of Australia, including but not limited to Japan, Philippines, Singapore, South Africa, United Kingdom, Canada, Israel, and the United States of America and participants understand and acknowledge that Australian Privacy Principal 8.1 will not apply to such disclosures of their personal information. By entering the Promotion, Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
- The Eligible Entrant agrees that, in the event they are an Eligible Winner, the Promoter may use their contact details for the purpose of facilitating the conduct of the Promotion and delivering the Prize. The Eligible Entrant will participate in all reasonable promotional activities in relation to the Promotion, as requested by the Promoter and its agents. This may include the Eligible Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and/or promotional purposes, for an indefinite period.
Entry Content
- Entries must be the Eligible Entrant’s original work. The Promoter reserves the right to require the Eligible Entrant to verify that the entry is the Eligible Entrant’s original work. If the Promoter is unable to verify that the entry is original work to its satisfaction, the entry will be deemed invalid.
- Eligible Entrants warrant that their entry is not in breach of any third party intellectual property rights. Eligible Entrants agree to indemnify the Promoter and its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of the warranty set out in this clause 27.
- By entering this Competition, Eligible Entrants grant the Promoter a non-exclusive licence to use the content of their entry, or any part of the content of the entry, in any way the Promoter wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Promoter’s business on its website, social media or in any marketing campaign, without payment to the Eligible Entrant of royalties or compensation. If requested by the Promoter, Eligible Entrants agree to sign any further documentation required by the Promoter to give effect to this clause 28.
- By entering this Competition, Eligible Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Eligible Entrant’s moral rights, and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.
General
- This Promotion is in no way sponsored, endorsed or administered by Meta. Any information provided by an Entrant is provided to us and not to Meta and Entrants release Meta from all liability in relation to this Promotion.
- All entrants have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third-party interference;
- any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any variation in market value to that stated in these terms and conditions;
- any tax implications; or
- the Prize or use of the Prize.
- If the Promotion cannot be conducted as intended for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right, in its sole discretion, to withdraw, cancel, terminate, modify or suspend the Promotion or, if necessary, to provide an alternative prize to the same value as the original Prize to the extent permitted by law and subject to any written directions made under applicable State or Territory Legislation.
- The Promoter does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion. Entrants should seek their own independent financial advice regarding any financial or tax implications related to the acceptance of the Prize.
- Entry to the Promotion is free. However, all costs associated with accessing the relevant websites are the entrant’s responsibility and are dependent on the Internet service provider used.
- Prizes are not transferable or exchangeable and are not redeemable for cash.
- These Terms and Conditions may be varied by the Promoter at any time without notice unless to do so would be prohibited by law.
- In these Terms and Conditions:
- “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth); and
- “Personal Information” means, for the purpose of the__ Privacy Act 1988__ (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
