Introduction

  1. The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL No. 241 411 (operating under the brand ‘Budget Direct’) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066, contact number 1300 858 747 (‘we’, ‘us’, ‘our’ or ‘Promoter’) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).

How to Enter

  1. These Terms and Conditions apply to the promotion “Dwayne Bennett’s Dolphins NRL Merchanside Competition” where entrants must, during the Promotion Period:
    1. follow Dwayne Bennett’s Facebook page at https://www.facebook.com/imdwaynebennett/;
    2. correctly answer a multiple-choice question via https://bdins.co/DwayneMerchCompetition and
    3. complete all required steps and fields on the entry form, including by providing their first and last names and a valid email address, and submit the form via https://bdins.co/DwayneMerchCompetition for the chance to win one (1) of three (3) Dolphin NRL Merchandise Packs (see the Eligibility and Participation section below) (Promotion).
  2. The Promotion commences at 11:00am Thursday 4th April 2024 and ends at 10:00am on Thursday 11th April 2024 (Promotion Period). All times are in Australian Eastern Standard Time.
  3. Entry into the Promotion and any offer of Budget Direct insurance is subject to the Insurer deeming that the risk is acceptable in accordance with its underwriting criteria. Any advice is general only and does not consider an individual’s needs.
  4. Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.

Eligibility and Participation

  1. Entrants must meet all of the following criteria during the Promotion Period and at the Draw Date to participate in the Promotion (Eligible Entrant):
    1. be aged 18 years or over;
    2. be an Australian resident. Australian resident means a person who resides in Australia and either:
      1. holds Australian or New Zealand citizenship; or holds an Australian permanent residency visa; or
      2. has resided in Australia continuously for six (6) months or more on a temporary work visa at the time of participating in the Promotion;
    3. not be a director, officer or employee of the Promoter, its related entities or agents and service providers, or any other person directly associated with the conduct of the Promotion or their immediate families;
    4. be a current and eligible ‘Phinlander’ who has previously signed up via https://www.phinland.com.au/ by inputting the requested details and submitting the fully completed membership form;
    5. provide a valid email address;
    6. agree to accept the Promotion’s Terms and Conditions; and
    7. agree to receive marketing from the Promoter.
  2. Each Eligible Entrant will be awarded a maximum of one (1) entry into the Promotion with each entry having an equal chance of winning the Prize. Additional entries will not be awarded for additional entry form submissions.
  3. Entries will be deemed accepted at the time of receipt by the Promoter, or as determined by the Promoter. Entries received will be considered final by the Promoter.
  4. The Promoter reserves the right to disqualify or delete any entry which contains (in the reasonable opinion of the Promoter) any content which is incomplete or indecipherable or contains profanity, potentially insulting, scandalous, racist, unlawful, abusive objectionable, inflammatory, or defamatory language.
  5. The Promoter may request the Entrant produce appropriate photo identification and other documentation to confirm, to the Promoter’s satisfaction, the Entrant’s eligibility to enter the Promotion and the validity of their entry, failing which any/all entries of that Entrant will be deemed invalid.
  6. If there is a dispute regarding the conduct of the Promotion, Entrants agree that the decision of the Promoter will be final and no further correspondence will be entered into.

Draw and Prizes

  1. The Prize Draw will take place at Level 7, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066 at 11.00am (AEST) (Draw Time) on Thursday 11th April 2024 (Draw Date).
  2. The prizes are three (3) x Dolphins NRL Merchandise packs (each, a Prize) valued at AU$329.92 each. Each Prize comprises of the following items:
  1. The total value of the prize pool is AU$989.76 (excl. GST).
  2. A total of three (3) Eligible Entrants will be randomly drawn via electronic draw on the Draw Date or Unclaimed Draw Date, as is relevant to each win one (1) Prize (Eligible Winer).
  3. Each Eligible Winner will be notified via their nominated email address provided on the entry form with particulars of how the Prize is to be delivered within five (5) hours of the Draw Time, or by no later than 4:00pm (AEST) on Thursday 11th April 2024, and their name will be published on the Terms and Conditions page via https://www.phinland.com.au/terms-conditions/merchcompetition within twenty-eight (28) days of the Draw Date, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to identify and notify the winners.

Unclaimed Prize Draw

  1. A Prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner by 11:00am (AEST) Thursday 25th April 2024 (Unclaimed Draw Time and Date) in accordance with clause 16.
  2. If a Prize remains unclaimed at the Unclaimed Draw Time and Date, an unclaimed prize draw (Unclaimed Prize Draw) will be held at the location listed in clause 12 using the same method detailed in clause 15, at the Unclaimed Draw Time and Date, subject to any written directions made under applicable State or Territory.
  3. The Eligible Winner of the Unclaimed Prize Draw will be notified via their nominated email address provided on the entry form with particulars of how the Prize is to be delivered within five (5) hours of the Unclaimed Draw Time, or by no later than 4:00pm (AEST) Thursday 25th April 2024, and their name will be published on the Terms and Conditions page via https://www.phinland.com.au/terms-conditions/merchcompetition within twenty-eight (28) days of the Unclaimed Draw Time and Date, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to identify and notify the winners.

Redemption of Prize

  1. The Eligible Winner must provide the Promoter with a valid postal address as the Prize will be supplied by the Promoter and will be delivered via post at no cost to the Eligible Winner’s nominated postal address within 28 days of the Draw Date or Unclaimed Draw Date, as is relevant. Once the Prize has been posted to the Eligible Winner, the Promoter takes no responsibility for the Prize or any part thereof being damaged, lost or stolen. The Eligible Winner is responsible for providing their correct postal address and the Promoter will not liable if the Prize is sent to the wrong postal address.
  1. The Promoter is committed to protecting your Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website at the following link: www.budgetdirect.com.au. It contains information about how entrants can complain about a breach of the Australian Privacy Principles and further details of how the Promoter will collect, store, use and disclose Personal Information can also be found there. Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at [email protected] .
  2. Entrants acknowledge that a further purpose for collection of their Personal Information is to contact the Entrant in the future with information about the Promoter or Insurer, including special offers, market research or to provide marketing materials via any medium including mail, and any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
  3. The Promoter will never sell an Entrant’s Personal Information to other companies, however, the Promoter may share an Entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties, who may contact the Entrant for their legitimate commercial purposes. Some of these parties may be located outside of Australia, including but not limited to Japan, Philippines, Singapore, South Africa, United Kingdom, Canada, Israel, and the United States of America and participants understand and acknowledge that Australian Privacy Principal 8.1 will not apply to such disclosures of their personal information. By entering the Promotion, Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
  4. The Eligible Entrant agrees that, in the event they are an Eligible Winner, the Promoter may use their contact details for the purpose of facilitating the conduct of the Promotion and delivering the Prize. The Eligible Entrant will participate in all reasonable promotional activities in relation to the Promotion, as requested by the Promoter and its agents. This may include the Eligible Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and/or promotional purposes, for an indefinite period.

General

  1. This Promotion is in no way sponsored, endorsed or administered by Meta. Any information provided by an Entrant is provided to us and not to Meta and Entrants release Meta from all liability in relation to this Promotion.
  2. All entrants have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third-party interference;
    3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in market value to that stated in these terms and conditions;
    5. any tax implications; or
    6. the Prize or use of the Prize.
  3. If the Promotion cannot be conducted as intended for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right, in its sole discretion, to withdraw, cancel, terminate, modify or suspend the Promotion or, if necessary, to provide an alternative prize to the same value as the original Prize to the extent permitted by law and subject to any written directions made under applicable State or Territory Legislation.
  4. The Promoter does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion. Entrants should seek their own independent financial advice regarding any financial or tax implications related to the acceptance of the Prize.
  5. Entry to the Promotion is free. However, all costs associated with accessing the relevant websites are the entrant’s responsibility and are dependent on the Internet service provider used.
  6. Prizes are not transferable or exchangeable and are not redeemable for cash.
  7. These Terms and Conditions may be varied by the Promoter at any time without notice unless to do so would be prohibited by law.
  8. In these Terms and Conditions:
    1. Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth); and
    2. “** Personal Information**” means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
